What Are Texas Impact Fees?

Texas impact fees are one-time charges authorized under Chapter 395 of the Texas Local Government Code. Cities, counties, and certain districts use them to recover the capital cost of water, wastewater, stormwater, and roadway facilities required to serve new development. Each jurisdiction must adopt a Land Use Assumptions and Capital Improvements Plan and update its fees at least every five years.

Texas does not authorize impact fees for parks, schools, or public safety, so totals are typically lower than in Florida or Arizona — but in high-growth suburbs around Austin, Dallas-Fort Worth, and Houston, water and roadway fees alone can run $10,000–$25,000 per single-family lot.
